This Privacy Policy explains what information we collect, how we use it, who we share it with, and the choices you have.
By using the Site or contacting us through it, you agree to the practices described in this Policy. If you do not agree, please do not use the Site.

2. Scope
This Policy applies to information collected through the Site, through our contact and quote request forms, by email or telephone, and in the course of providing our transportation services. It does not apply to third-party websites, platforms, or services that we do not control, including those we may link to.
3. Information we collect
3.1 Information you provide directly
When you submit our contact form or quote request form, or when you email or call us, we may collect:
- First and last name
- Email address
- Telephone number, if you provide it
- Company or organization name, if you provide it
- The content of your message, inquiry, or quote request
3.2 Business and shipment information
When you engage our services, or in the course of preparing a quote, we may collect and process operational information such as:
- Container, chassis, booking, and rail reference numbers
- Pickup and delivery addresses and appointment windows
- Bills of lading, delivery orders, customs and commercial documentation
- Commodity descriptions, weights, and handling requirements
- Names and contact details of your employees, agents, warehouse personnel, brokers, or consignees
- Billing and accounts-payable contact information
Most of this information is business information rather than personal information. Where it identifies an individual, it is treated as personal information under this Policy.
3.3 Information collected automatically
When you visit the Site, our hosting provider and analytics tools may automatically record:
- IP address and approximate location derived from it
- Browser type, device type, and operating system
- Referring URL and pages viewed, with dates and times
- Interactions with the Site, such as clicks and form submissions
- Server and security logs
3.4 Sensitive information
We do not seek and do not knowingly collect sensitive personal information through the Site, including government identification numbers, financial account numbers, health information, biometric data, precise geolocation, or information revealing racial or ethnic origin, religious beliefs, or immigration status. Please do not include such information in a contact or quote form message.

We use the information described above to:
- Respond to inquiries, prepare quotes, and communicate with you
- Arrange, dispatch, execute, and track intermodal, drayage, and container repair services
- Coordinate with rail terminals, carriers, warehouses, customs brokers, and other parties involved in your shipment
- Invoice, collect payment, and maintain accounting records
- Maintain safety, insurance, claims, and regulatory compliance records
- Operate, secure, maintain, and improve the Site
- Detect and prevent fraud, abuse, and unauthorized access
- Send service-related and, where permitted, commercial communications, which you may opt out of at any time
- Comply with applicable law and respond to lawful requests from authorities
5. Legal grounds for processing
Where a legal basis is required by applicable law, we rely on: performance of a contract or steps taken at your request prior to entering into one; compliance with legal obligations, including transportation, customs, tax, and safety requirements; our legitimate interests in operating and securing our business; and your consent, where consent is required and given.
6. How we share information
We do not sell your personal information, and we do not share it for cross-context behavioral advertising or targeted advertising purposes.
We disclose information only as follows:
- Operational partners. Rail carriers and terminals, ocean carriers and steamship lines, motor carriers and owner-operators, warehouses, distribution centers, container yards, repair facilities, and customs brokers, as needed to move or service your freight.
- Service providers. Website hosting, email, form processing, transportation management and dispatch software, telephony, accounting, and IT security vendors that process information on our behalf and under contractual confidentiality obligations.
- Professional advisors and insurers. Attorneys, accountants, auditors, and insurance carriers or claims adjusters, where relevant to a claim, audit, or legal matter.
- Authorities. Government agencies, courts, and law enforcement when required by law, subpoena, customs or border requirements, or to protect our rights, safety, or property.
- Corporate transactions. A successor entity in connection with a merger, acquisition, financing, reorganization, or sale of assets.
7. Cross-border transfers
We operate on both sides of the United States–Mexico border. Information collected may be stored in the United States and transferred to or accessed from Mexico, or from other countries where our service providers operate. Data protection laws in these countries may differ from those in your country of residence. Where required, we implement contractual and technical safeguards for such transfers.
8. Cookies and similar technologies
The Site is built on WordPress and uses cookies and similar technologies to keep the Site functioning, remember your preferences, and understand aggregate usage. These may include:
- Strictly necessary cookies, required for the Site and its forms to work and to protect against abuse.
- Functional cookies, which remember settings and improve your experience.
- Analytics cookies, which measure traffic and Site performance in aggregate.
You can block or delete cookies through your browser settings. Disabling strictly necessary cookies may prevent parts of the Site, including the contact and quote forms, from working correctly. We do not respond to browser “Do Not Track” signals, as no common standard has been adopted for them; we do honor recognized opt-out preference signals where required by law.
9. Data retention
We keep personal information only as long as necessary for the purposes described in this Policy. In general:
- Inquiries and quote requests that do not result in a business relationship: up to 24 months.
- Shipment, dispatch, and billing records: for the period required by applicable transportation, tax, insurance, and commercial recordkeeping rules, and thereafter as needed for claims or disputes.
- Website server and security logs: typically up to 12 months.
When information is no longer needed, we delete it or render it anonymous.
10. Security
We maintain administrative, technical, and physical safeguards intended to protect information against loss, misuse, and unauthorized access or disclosure, including encrypted connections to the Site, access controls, and vendor due diligence. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. Please do not send confidential documents through the Site forms; email them directly to your Flash Intermodal contact.
11. Your rights and choices
11.1 All users
You may ask us to access, correct, or delete personal information we hold about you, or to stop sending you commercial communications. You may unsubscribe from marketing emails at any time using the link in the message or by contacting us. Service-related messages about active shipments are not marketing and cannot be opted out of while a shipment is in progress.
11.2 Texas residents
Under the Texas Data Privacy and Security Act, Texas residents may request to confirm whether we process their personal data and access it; correct inaccuracies; delete personal data they provided or that we obtained about them; obtain a portable copy of data they provided, where processing is automated; and opt out of processing for targeted advertising, the sale of personal data, or profiling in furtherance of decisions producing legal or similarly significant effects. We do not sell personal data, engage in targeted advertising, or conduct such profiling. We will respond within 45 days, with one 45-day extension where reasonably necessary. If we decline a request, you may appeal by writing to privacy@flashintermodal.com with the subject line “Privacy Appeal”; we will respond to the appeal within 60 days and, if it is denied, will provide a means of contacting the Texas Attorney General to file a complaint.
11.3 California residents
If the California Consumer Privacy Act applies to you, you may request disclosure of the categories and specific pieces of personal information we have collected, the sources, the business purposes for collection, and the categories of third parties to whom we disclose it; request deletion or correction; and opt out of any sale or sharing of personal information. We do not sell or share personal information as those terms are defined by the CCPA. We will not discriminate against you for exercising these rights.
11.4 Residents of Mexico
If you are in Mexico, you may exercise your ARCO rights — access, rectification, cancellation, and opposition — as well as revoke your consent or limit the use or disclosure of your personal data, by writing to privacy@flashintermodal.com. Your request should include your name, contact details, a description of the data concerned, and proof of identity or representation.
11.5 How to submit a request
Send requests to privacy@flashintermodal.com or to the mailing address in Section 1. We will verify your identity before acting, generally by confirming information already in our records or by contacting you at an email address or phone number associated with the request. An authorized agent may submit a request on your behalf with written authorization. Exercising these rights is free of charge, except for manifestly unfounded or excessive requests.
12. Third-party links
The Site may link to third-party websites, portals, or tracking systems operated by carriers, terminals, or partners. We are not responsible for their content or privacy practices. Review their privacy policies before providing information to them.
13. Children
The Site and our services are intended for businesses and adults. We do not knowingly collect personal information from anyone under 18 years of age. If you believe a minor has provided us information, contact us and we will delete it.
14. Changes to this Policy
We may update this Policy to reflect changes in our practices, technology, or legal requirements. The revised version will be posted on this page with a new effective date. Material changes will be identified in a notice on the Site. Continued use of the Site after an update constitutes acceptance of the revised Policy.
